These Terms of Service (the “Terms”) govern your use of Elpis (the “App”), provided by Elpis (“we”, “us”). By using the App you agree to these Terms.

These Terms apply to all dealings between you and us regarding the App.
Our handling of personal information is governed by the Privacy Policy, which forms part of these Terms.
The App lets you record your mood, habits, and physical condition day to day, and grows a monster in response to those records.
What you record shapes how the monster grows. Missing a day never causes you to lose the monster.
You can start using the App without registering a name or email address. An anonymous account is created automatically on first launch.
You may optionally link an Apple or Google account. Linking is what allows your data to move to a new phone or survive a reinstall.
If you do not link an account, your data never leaves the device. If the device is lost, damaged, or reset, or the App is deleted, your records cannot be recovered. We are unable to restore them.
If the Apple or Google account you try to link is already connected to a different Elpis account, linking does not happen. Instead you switch to that existing account.
When this happens, the records made on this device before the switch are not carried over. The App shows a confirmation screen before the switch; please read it. Once you have switched, data that was not carried over cannot be recovered.
You can delete your account at any time from Settings > Data > Delete account. What is removed, and what is not, is set out in Privacy Policy section 8.
Deleting your account does not cancel your subscription (see section 5).
Elpis Plus is the App’s paid subscription.
Your first monster is entirely free, all the way to graduation. Elpis Plus becomes necessary when you hatch your second and subsequent eggs.
Even without Elpis Plus, none of the following is restricted:
Second and subsequent eggs remain as eggs in the room until you subscribe.
Ending your subscription does not affect the monster you are currently raising. You can raise it fully and see it graduate. Elpis Plus becomes relevant again at the next egg.
Payment for Elpis Plus is handled by the App Store (Apple Inc.) or Google Play (Google LLC). We do not receive your payment details.
The price is the amount shown on the App’s purchase screen and in the relevant store. If we change the price, existing subscribers will be notified — and asked to consent where required — through the procedures each store defines.
Elpis Plus is an auto-renewing subscription.
Cancel in your store’s settings. You cannot cancel inside the App.
Deleting your account does not cancel the subscription. If you delete the account without cancelling, billing continues. Cancel first.
Refunds are governed by the policies of the App Store or Google Play. We cannot issue refunds ourselves.
The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease.
We are not responsible for decisions you make based on the App.
The App shows, as a number of stars, how much each habit appears to affect mood.
The data behind that display comes from one person — the developer — recording for 6.5 years (2,329 days). Of those, 1,854 days include a mood entry.
So the effect stars are:
Treat them as one person’s result — a starting point when choosing which habits to try.
You must not:
Copyright and other intellectual property rights in the App, including the monster designs, images, text, and software, belong to us or to the rightful owners.
The content of the records you enter belongs to you. We use it only within the scope set out in the Privacy Policy.
We may change the App or suspend it without prior notice.
If we discontinue the App, we will give you as much notice as we reasonably can, in the App or by other means. Where subscriptions are active, we will act through the procedures each store defines.
Nothing in these Terms limits any liability that cannot be limited by law, or removes any right you have as a consumer under the mandatory law of the country where you live.
These Terms are governed by the laws of Japan.
Disputes between you and us relating to the App will be submitted to the Tokyo District Court as the court of first instance.
If you use the App as a consumer, this does not deprive you of the protection of the mandatory laws of your country of residence, nor of your right to bring proceedings in the courts of that country where the law gives you that right.
We may revise these Terms where we consider it necessary. When we do, we update the “Last revised” date on this page.
Where a change is materially to your disadvantage, we will tell you in advance, in a way you will see, such as a notice inside the App.
